PHILADELPHIA (AP) _ Among the most notorious on-screen gaffes ever, Janet Jackson's breast-baring "wardrobe malfunction" on CBS during the 2004 Super Bowl halftime show drew a $550,000 indecency fine from the Federal Communications Commission. Now a federal appeals court has thrown it out.

A panel of the 3rd U.S. Circuit Court of Appeals ruled Monday that the FCC "acted arbitrarily and capriciously" in issuing the fine for the fleeting image of nudity, which it noted lasted just over half a second. An estimated 90 million people watching the Super Bowl heard Justin Timberlake sing, "Gonna have you naked by the end of this song," as he reached for Jackson's bustier.

The court said the FCC deviated from its nearly 30-year practice of fining indecent broadcast programming only when it was so "pervasive as to amount to 'shock treatment' for the audience."

Duke University law professor Stuart M. Benjamin, a telecommunications law expert, called the decision "a slap in face for the FCC....

The new iPhone 3G released this morning at 8am. Is it worth camping out over night or standing in line for hours just to be one of the first to get one???
I haven't quite grasped the idea of why people do this. It's not like there is only limited stock- they are still selling the original version! Maybe it's the new pricing that is significantly lower than the first $199 for 8GB and $299 for 16GB- who knows!
All I know is I don't think it's that important to brave the heat for a phone... what about you???

Anybody know about children's spanish lessons that don't cost a fortune? Everything I find is so expensive and I would love to get my son into spanish lessons. Does anyone know somebody that has good references that may do this on the side?

This week will be the start of the IRS sending out tax rebates. They tell everyone to go out and spend it to raise the economy, but alot of people are planning to save it. What are you going to do with it?

I'm pretty fed up with the discussion on the Nampa Library. I don't understand why the Library board can't make up its mind. I don't like the fact that people have to ask for a couple of books that may help them.

Sex is a natural act. So why are people worried about others who might read something about sex? Sure, some of those "unnatural acts" aren't something the Christian Right approves of, but why is it their business who does what?

Are these moralists afraid their church going friends having some fun?

Get real! There's more to life than just those two books. People should spend more time experimenting with sex than worrying about what's on the shelves at the library.

What is with people not stopping for pedestrians in crosswalks? Living next to a school on a fairly busy street, I see this on a daily basis. Not only do I see it, it happens to me. Nobody stops, let alone slow down. Its going to take a tragedy, before people realize when you see someone attempting to cross, stop for them.

How many times have you been in a school zone and a car speeds through there like a sign was never posted? Or you are driving 20-25 mph, the posted speed limit in the zone and a car is tailgating you with little patience? Are school signs foreign to some people in the Treasure Valley?
Unfortunately, the police can not be stationed in school zones all of the time to monitor the traffic, nor should they have to. I am glad that in some school zones they have now installed the flashing light that seems to slow more motorists down.
I get so frustrated with people who do not obey these signs posted for the children's protection. What is it saying about how we feel about our youth?
